From The Pittsburgh Daily Commercial of 27 September 1871:
...Thomas Gelston, of the Mayor's police is indicted for the murder of Lawence Dowling. It will be remebered that on the 16th inst. a pic-nic was being held at Glenwood Grove. A difficulty occurred, and Gelston attempted to quell the disturbance.
Being set upon by several persons, and thrown to the ground, the officer discharged his revolver, in the air. as it was claimed, to frighten off his assailants.
Dowling, who was near the scene of the disturbance, but, as was claimed, not engaged in it, was struck by the ball from the pistol, receiving a wound from the effects of which he died at his home in East Birmingham on the following day.
The facts of the case have been fully reported before in this paper, and we need not report the testimony here. The first witness called was the prosecutor in the case, who repeatred his testimony before the Coroner's jury. Dr Donnelly described the wound inflicted on yooung Dowling, and persons who had been at the pic-nic and saw the affray followed.
The jury after an absence of about ten minutes, brought in a verdict of not guilty, and Mr. Gelstron was discharged.
